Terms and Conditions for the “Sauce Up Your Summer” Promotional Competition

The name of the competition is “Sauce Up Your Summer”.

The competition commences 14 December 2020 and ends 26 February 2021.

This competition is brought to you by Illovo Sugar (South Africa) (Pty) Ltd.

Application and interpretation

Participation in the Sauce up your Summer promotion (“Promotion”) is subject to these terms and conditions (“Terms and Conditions”) and any person participating in this Promotion agrees to be bound by these Terms and Conditions.
For the purposes of these Terms and Conditions:
- “Participant” means any person who enters, competes in or is otherwise eligible to win in this Promotion;
- “Participating Store” means any retail store within which the Promotion is being run;
- “Promoter” means Illovo Sugar (South Africa) (Pty) Ltd; and
- “Illovo Group” means the Promoter and any party that the Promoter directly or indirectly controls or is controlled by.

Duration

The Promotion will run from 00:00 on 14 December 2020 until 23:59 on 26 February 2021 (“the Promotion Period”), after which date the Promotion will automatically terminate and no further entries will be accepted.
In addition to any other rights contained in these Terms and Conditions, the Promoter reserves the right to terminate or curtail the Promotion Period (without incurring any liability to any Participant) at any time with immediate effect by publishing a notice to that effect on www.illovosugarsa.co.za and/or its social media pages and each Participant waives any claim it may have arising out of that termination.
Similarly, the Promotion Period may be extended at the sole discretion of the Promoter. If this is the case, the Promoter will provide notice of this on the website and/or social media pages.

Participants

Subject to the provisions below, this Promotion is open to all residents of South Africa of the age 18 (eighteen) years or older with a valid ID/passport.
Participants must comply with these Terms and Conditions in order to qualify for this Promotion.
No members, employees, directors, agents, Participating Stores or consultants of the Promoter or the Illovo Group (or any of their immediate families) may enter this Promotion.
Winners will need to produce their ID book or passport to validate that they are over the age of 18 (eighteen).

Main Prize

The main prize is a Russell Hobbs Blender Set.
There are 3 (three) main prizes being awarded (a total of 3 winners) during the Promotion Period.
1 (one) main prize winner will be drawn, via an independent auditor, at the end of each month during the Promotion Period.
The main prize is non-refundable, non-exchangeable and non-transferable.
Prizes cannot be exchanged for an alternative prize and no negotiations will be entered into.
Winners shall be notified via private message on Facebook/Instagram. Participants will have 48 hours to respond to the message to claim their prize, after which the prize will be forfeited and a redraw will take place.
Winners must ensure that they have provided their correct details. Neither the Promoter, nor its agents or consultants will be liable for any failure to provide correct details.

Secondary Prize

The secondary prize is an Illovo hamper.
There are 9 (nine) Secondary Prizes being awarded (a total of 9 winners) during the Promotion Period.
3 (three) secondary prize winners will be drawn, via an independent auditor, at the end of each month during the Promotion Period.
The secondary prize is non-refundable, non-exchangeable and non-transferable.
Prizes cannot be exchanged for an alternative prize and no negotiations will be entered into.
Winners shall be notified via private message on Facebook/Instagram. Participants will have 48 hours to respond to the message to claim their prize, after which the prize will be forfeited and a redraw will take place.
Winners must ensure that they have provided their correct details. Neither the Promoter, nor its agents or consultants will be liable for any failure to provide correct details.

Main Prize Promotion

Participants must purchase any bottle of Illovo Topping Sauce during the Promotional Period to qualify.
Participants must then visit the Promotional website: www.illovosummer.co.za and follow the prompts to enter.
Participants must retain their till slips as proof of purchase.
No entries by post or any other form will be accepted.
Incorrect or incomplete entries will be considered invalid.
Only one entry per valid till slip.
Winners will need to provide a copy of their ID, a signed undertaking as confirmation for compliance with these Terms and Conditions and such other documents or information reasonably required by the Promoter or its agent, in order to redeem the prize.

Secondary Prize Promotion

Participants must:
- Create a dish using any of the Illovo Topping Sauces (recipes can be found at www.illovorecipes.co.za)
- Take a clear photo of the completed dish
- Upload it to:
  - The Promotional post’s comments section on Facebook (@IllovoSugarSA)
  - OR
  - The Participant’s Instagram profile or story and tag the Promoter (@illovosugar_sa)
Any post containing vulgarity, profanity, or any content deemed unsuitable by the Promoter will be removed and the Participant disqualified.
No entries by post or any other form will be accepted.
Incorrect or incomplete entries will be considered invalid.
Winners will need to provide a copy of their ID, a signed undertaking as confirmation for compliance with these Terms and Conditions and such other documents or information reasonably required by the Promoter or its agent, in order to redeem the prize.

General

Winners’ details may be displayed on the website at www.illovosugarsa.co.za and other Illovo Sugar social media and marketing platforms.
Any Participant may refuse to participate in any marketing or have their image used by the Promoter by notifying the Promoter thereof in writing.
In the event of a dispute, the decision of the Promoter will be final, and binding and no correspondence will be entered into.
Participants who, in the Promoter’s sole determination, act unlawfully, fraudulently, in breach of these Terms and Conditions or otherwise dishonestly may be disqualified from participating in the Promotion and shall not be eligible to win any prize.
If the winner/s fail/s to comply with these Terms and Conditions, the winner/s will be disqualified and will forfeit the prize.
Not all Participants are guaranteed winners.

These Terms and Conditions shall be governed by the laws of the Republic of South Africa.

Exclusions of liability and indemnity

Without limiting any other exclusion provided for in these Terms and Conditions, the Promoter and/or the Illovo Group will not be liable for any loss, expense, costs, liability, claim or damages (whether direct, indirect or consequential), arising out of or in connection with the participation in this Promotion.
Nothing in these Terms and Conditions is intended to, or must be understood to, unlawfully restrict, limit or avoid any rights or obligations, as the case may be, created for either the participant or the Promoter in terms of the Consumer Protection Act, 68 of 2008 ("CPA"), if applicable.
Qualifying Participants hereby consent to and undertake to expeditiously do all things necessary to enable the Promoters to comply with their obligations under the CPA (where applicable) including, but not limited to, providing and the use of such personal information as may be required in order to facilitate handing over the prize.
The Promoter is not liable for any technical failure that may result in an entry not being successfully submitted.
Any prize is accepted by a winner at his/her own risk and the Promoter is not liable, at any time, for any defect in the prize.
The Promoter can be contacted in relation to any product in the secondary prize Illovo hamper.
By entering the Promotion and/or accepting any prize, the Participants hereby indemnify, release and hold harmless the Promoter including its subsidiaries, holding companies and affiliates and their directors, employees, agents, suppliers and contractors from and against any actions, claims and/or liability for injury, loss, damage, expense, claims and/or damages of any kind resulting in whole or in part, directly or indirectly, from participation in the Promotion, and/or the use, acceptance or possession of a prize, and/or participation (or non-participation) in a prize-related activity.
Without limiting any other exclusion provided for in these Terms and Conditions, the Promoter will not be held liable for any harm or consequential loss as a result of use of the prize.
